Understanding UAE Jurisdiction: Courts, Free Zones, and Where Your Debtor Is Registered

The UAE has multiple legal jurisdictions, and which one applies to your debtor significantly affects the recovery strategy. CentralSM navigates all of them.

Onshore UAE Courts

Companies registered under the Department of Economic Development (DED) in Dubai, Abu Dhabi, Sharjah, or other emirates fall under the jurisdiction of UAE civil courts. Proceedings are conducted in Arabic, and judgments are enforced through UAE enforcement courts. CentralSM works with qualified UAE-licensed legal partners to file and pursue these cases on your behalf.

DIFC Courts (Dubai International Financial Centre)

The DIFC has its own common-law court system, modelled on English law and operating in English. If your contract contains a DIFC governing law or jurisdiction clause — or if the debtor is a DIFC-registered entity — recovery proceeds through the DIFC Courts. DIFC judgments are also widely enforceable internationally, making this an attractive route for foreign creditors.

ADGM Courts (Abu Dhabi Global Market)

Similar to DIFC, the ADGM has its own independent common-law court system based in Abu Dhabi. If your debtor is an ADGM-registered entity, ADGM court proceedings apply.

Free Zone Tribunals

Entities registered in JAFZA (Jebel Ali Free Zone), DMCC (Dubai Multi Commodities Centre), Dubai Airport Free Zone, and other major free zones may be subject to their own internal dispute resolution mechanisms as well as UAE civil courts, depending on the nature of the dispute and the contract terms.

Step 2: Formal Demand and Amicable Recovery

CentralSM issues a formal demand letter in English and Arabic, carrying legal weight and signalling that the matter is being professionally managed. Our team makes direct contact with the debtor. In many international cases, the debtor’s priority changes significantly when they understand that a professional recovery firm is acting locally on behalf of the foreign creditor. Approximately 70% of our international cases resolve at this stage.

Step 3: Legal Action and Asset Enforcement

Where the debtor does not respond or refuses to pay, CentralSM escalates without delay. We file in the appropriate UAE court through our legal partners, pursue payment orders or civil judgment, and apply for:

  • Bank account freezing orders
  • Asset attachment on property, vehicles, or business assets
  • Travel bans on individual directors, owners, or guarantors
  • Enforcement against business premises or trade licence renewal

Enforcing Foreign Judgments in the UAE

If you already hold a court judgment against a UAE debtor from a foreign court — in the UK, EU, India, or elsewhere — CentralSM can pursue enforcement of that judgment within the UAE. The UAE has bilateral enforcement treaties with a number of countries, and even without a treaty, judgments from reciprocal jurisdictions can often be enforced through UAE civil courts.

What Documents Do You Need?

For most international recovery cases, we need:

  • The signed contract, purchase order, or agreement with the UAE debtor
  • Unpaid invoices with delivery or service confirmation
  • Email correspondence showing the debt was acknowledged or payment was promised
  • Any bounced cheques and bank return notices
  • The debtor’s UAE trade licence or company registration number (if you have it)

Do I need to come to Dubai to pursue my case?

My debtor says they are disputing the invoice. Can I still recover?

Yes, in many cases. Disputes are frequently raised to delay or avoid payment rather than because the debtor has a genuine legal defence. We assess the strength of the dispute against your documentation and advise accordingly. Even in genuinely contested matters, mediated settlement is often achievable before court.

The debtor’s company appears to have closed or been deregistered. What can I do?

This is a common obstacle and not always the end of recovery. CentralSM conducts asset tracing and debtor location investigations. We investigate whether assets were transferred before closure, whether directors have personal liability, and whether the company is genuinely dissolved or simply dormant.

How long does international debt recovery take in the UAE?

Amicable settlement: typically 2 to 8 weeks. UAE payment order (execution): 2 to 4 months. Civil court litigation: 6 to 18 months. DIFC court proceedings: typically 6 to 12 months. We always pursue the fastest available route first.

What currencies can I receive my recovery in?

UAE court judgments are enforced in AED. We then arrange remittance to you in your preferred currency via international wire transfer. Currency conversion is at the prevailing market rate.
